Terms of Service

These Terms of Service ("Terms") govern your use of the Enurgy mobile application, this website and the Enurgy membership (together, the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility and accounts
You must be at least 16 years old to create an account. You are responsible for the accuracy of your account details, for keeping your login credentials secure, and for all activity that takes place under your account. Tell us immediately if you suspect unauthorised use.
2. The Service
Enurgy provides a wellness café and listening lounge together with an app that offers personalised drink and blend recommendations, membership benefits, event booking and ordering features. Features may change, and we may add, modify or withdraw parts of the Service.
3. Not medical advice
Enurgy is a hospitality and wellbeing service, not a healthcare provider. Recommendations, wellbeing insights and content in the App are for general informational purposes only and are not medical advice, diagnosis or treatment. Always consult a qualified healthcare professional before making decisions about your health, and never disregard professional advice because of something in the App. If you have allergies or dietary requirements, check with our team in person before ordering.
4. Membership and subscriptions
- Memberships are offered as recurring subscriptions billed monthly in advance until cancelled.
- Prices and tier benefits are shown in the App before you purchase and may change with at least 30 days' notice.
- Subscriptions purchased through the Apple App Store or Google Play are billed by that store and renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- You can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- Refunds for store-billed subscriptions are handled under the policies of Apple or Google. For anything billed directly by us, contact us and we will apply your statutory rights.
4a. Your cancellation rights (UK consumers)
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have 14 days from the start of a membership bought directly from us to cancel for a full refund. If you ask us to start the service immediately, we may deduct a proportionate amount for the days you have used. Email developer@enurgylab.com to cancel. Purchases made through the Apple App Store or Google Play are refunded under those stores' policies. Your rights under the Consumer Rights Act 2015 — that services are supplied with reasonable care and skill — always apply.
5. Acceptable use
You agree not to:
- Use the Service unlawfully or to infringe anyone else's rights.
- Attempt to gain unauthorised access to our systems or other users' accounts.
- Reverse engineer, scrape, copy or resell any part of the Service.
- Interfere with the operation, security or integrity of the Service.
- Upload content that is unlawful, abusive, misleading or harmful.
We may suspend or terminate accounts that breach these Terms or that we reasonably suspect are being used fraudulently.
6. Intellectual property
The Enurgy name, logo, app, website, design, imagery, recipes and content are owned by Enurgy or its licensors and are protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable and revocable licence to use the App for its intended purpose. Any content you submit remains yours; you grant us a licence to use it to operate and improve the Service.
7. Third-party services
The Service can integrate with third-party platforms such as Apple Health, WHOOP and Oura, and relies on third-party payment and hosting providers. We are not responsible for those services, their availability or their content, and your use of them is subject to their own terms.
8. Availability and liability
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, Enurgy is not liable for indirect or consequential losses, and our total liability arising from the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded. Nothing in these Terms affects your statutory consumer rights.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or end your access if you breach these Terms or if we discontinue the Service, in which case we will give reasonable notice and refund any unused prepaid period.
10. Complaints
If something goes wrong, email developer@enurgylab.com and we will acknowledge within two business days and aim to resolve the matter within 14 days. If we cannot resolve it between us, you may be able to use an alternative dispute resolution scheme, and you keep the right to bring a claim in the courts.
11. Data protection
We process personal data in line with the UK GDPR and the Data Protection Act 2018, as described in our Privacy Policy, which forms part of these Terms.
12. Changes, law and contact
We may update these Terms; the current version is always on this page and material changes will be notified in the App. These Terms are governed by the laws of England and Wales, and its courts have exclusive jurisdiction — though if you live in Scotland or Northern Ireland you may also bring proceedings there.
